Article 1. Applicability
1.1 These General Terms and Conditions apply to all offers, orders and agreements of Mint Luxury Vintage.
1.2 Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions.
1.3 The provisions of these Conditions can only be deviated from in writing, in which case the other provisions remain in full force.
1.4 All rights and claims, as stipulated in these Conditions and in any further agreements for the benefit of Mint Luxury Vintage, are also stipulated for the benefit of intermediaries and other third parties engaged by Mint Luxury Vintage.
Article 2. Offers / agreements
2.1 An agreement is only concluded after acceptance of your order by Mint Luxury Vintage. Mint Luxury Vintage is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Mint Luxury Vintage will notify this within five (5) working days after receipt of the order.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in euros, and VAT is charged on second-hand items. Import duties are for the consumer.
3.2 Payment can be made via Bancontact, MasterCard, Visa and ApplePay. In case of payment by bank or giro, the date of payment is the date of crediting the giro or bank account of Mint Luxury Vintage.
3.3 If the payment term is exceeded, Mint Luxury Vintage can decide whether or not the order will be canceled.
Article 4. Shipping / delivery / return
4.1 We ship worldwide.
4.2 We ship all our items fully insured with POSTNL. After we receive the payment, we ship your item between 24-48 hours.
4.3 Shipping in Europe takes around 2-5 work days. Shipping outside Europe takes around 5-10 work days. We are not responsible for the duration of the delivery.
4.4 As soon as your item is shipped you will receive your shipping number so you can track your item at any time. Import duties, taxes or any other costs associated with importing the purchased item are not the responsibility of Mint Luxury Vintage. These costs are for the buyer. Please always check your country import duties outside the European Union.
4.5 If the item you ordered is not available we will contact you the same day. Orders placed during the weekend will be shipped on Monday.
Article 5. Reservation of ownership
5.1 The ownership of the delivered products is only transferred if you have paid all that you owe to Mint Luxury Vintage on the basis of any agreement. The responsibility with regards to the products already passes to you from the moment of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products delivered by Mint Luxury Vintage.
6.2 Mint Luxury Vintage does not guarantee that the products delivered to you do not infringe on any (unwritten) intellectual and / or industrial property rights of third parties.
Article 7. Guarantee for authenticity
7.1 Mint Luxury Vintage guarantees that the products to be delivered meet the usual requirements and standards that can be imposed on them and are free of any (additional) defects.
7.2 If you have purchased an item from Mint Luxury Vintage and have doubts about authenticity, please contact Mint Luxury Vintage. Mint Luxury Vintage can then have the item additionally authenticated by a third party. The costs are for the customer.
Article 8. Force majeure
8.1 Without prejudice to the other rights to which it is entitled, in the event of force majeure Mint Luxury Vintage has the right, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without judicial intervention. This by informing you in writing, without Mint Luxury Vintage being obliged to pay any compensation, unless this would be unacceptable in the circumstances to the standards of reasonableness and fairness.
8.2 Force majeure means any shortcoming which can not be attributed to Mint Luxury Vintage, because it is not due to its fault and not under the law, legal act or generally accepted for its account.
Article 9. Miscellaneous
9.1 If you provide Mint Luxury Vintage with an address in writing, Mint Luxury Vintage is entitled to send all orders to that address, unless you provide Mint Luxury Vintage with a written notice of another address to which your orders are to be sent before the item has been shipped.
9.2 If Mint Luxury Vintage allow deviations from these Conditions, whether or not tacitly, for a short or longer period, this shall not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any right on the grounds that Mint Luxury Vintage applies these Conditions smoothly.
9.3 Mint Luxury Vintage is authorized to use third parties in the execution of your order(s).
Article 10. Applicable law and competent court
10.1 Belgian law applies exclusively to all rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as to these Terms and Conditions.
10.2 All disputes between parties will only be submitted to the competent court in Belgium.
Article 11. Copyright / Copyright
11.1 On all images or parts of images that are available on this website without the express permission of the author, copying of prints or complete sections of the text of downloaded documents is strictly prohibited by copyright.
